You can appeal a New Jersey municipal court conviction, including a DWI, to the Superior Court in the same county. The municipal court must receive your Notice of Municipal Court Appeal within 20 days of the conviction, counting weekends and holidays (Rule 3:23-2). Within five days after filing, the notice must also be served on the prosecutor and filed with the county Criminal Division with the fee.
The deadline is strict
Rule 3:23-2 requires the notice of appeal to be filed with the municipal court clerk within 20 days after the judgment. The NJ Courts guide says the court must receive the form within 20 days, including weekends and holidays, and that a late appeal will not be heard (NJ Courts: municipal appeals). The Appellate Division has confirmed that courts cannot enlarge this time.
The steps
- File the Notice of Municipal Court Appeal with the municipal court that decided your case.
- Order the transcript of the municipal court hearing (you pay in advance unless you qualify for a waiver).
- Within five days, serve a copy on the prosecutor and file a copy with the Criminal Division Manager's office in the county, with the filing fee and a certification that you filed and served on time.
- The Superior Court judge decides the case anew on the municipal court record. There is usually no new trial or new witnesses.
What the appeal can and cannot do
The Superior Court judge reviews the transcript and exhibits and makes an independent decision on guilt and sentence. You generally cannot add new evidence. If you are thinking about appealing a DWI, ask about the sentence, too: some penalties may be stayed while the appeal is pending, but that is up to the court. See our DWI guide and second and third DWI.
Talk to us before day 20
Because the time limit is short and strict, call us as soon as the municipal judge rules. We can review whether an appeal makes sense and make sure the papers are filed and served on time.

Yes. DWI and refusal convictions from municipal court are appealed the same way, within 20 days.
